- Customer service is available Monday to Friday, 9:00–17:00.
§ 3. Technical requirements
To use the Store you need: a device with internet access, an up-to-date web browser with JavaScript and cookies enabled, and an active e-mail account. The Seller charges no fee for using the Store itself; data transmission costs are borne by the Customer under the agreement concluded with their internet provider.
§ 4. Placing orders and conclusion of the contract
- Information about Goods published in the Store constitutes an invitation to conclude a contract within the meaning of art. 71 of the Polish Civil Code, and not an offer.
- An order is placed by adding the Goods to the basket, selecting the delivery and payment method and confirming the order with the button labelled “Order with an obligation to pay”.
- Placing an order constitutes an offer to conclude a sales contract. The contract is concluded when the Seller confirms acceptance of the order by a message sent to the Customer's e-mail address.
- Orders may be placed with or without a registered account. Creating an account is free of charge and voluntary.
- The Seller may refuse to accept an order if the Goods are unavailable, the Customer's details are incomplete or the order raises justified doubts as to its authenticity. In such a case the Seller informs the Customer without delay and returns any payments received.
- Goods marked as made to individual order are manufactured according to the specification agreed with the Customer, after it has been confirmed in writing (including by e-mail) by both parties.
§ 5. Prices
- The prices shown in the Store are gross prices expressed in Polish zloty and include VAT at the applicable rate.
- The price does not include delivery costs or any cash-on-delivery fee; these costs are presented before the order is confirmed.
- The price visible at the moment the order is placed is binding on the parties.
- In the case of price reductions, the Seller also states the lowest price of the Goods from the 30 days preceding the reduction, in accordance with art. 4 of the Polish Act on informing about the prices of goods and services.
§ 6. Payments
- The Seller offers: instant transfer and card payment through payment operators (Przelewy24, Tpay, PayU), ordinary bank transfer and cash on delivery.
- Bank account number for ordinary transfers: PL00 0000 0000 0000 0000 0000 0000. Please quote the order number in the transfer title.
- The cash-on-delivery fee is 5,00 PLN and is added to the order value. Cash on delivery is not available with personal collection.
- With prepayment, the order is processed once the payment has been credited. The Seller may cancel an unpaid order after 7 days from the date it was placed, following a prior e-mail reminder.
- A receipt or an invoice is issued for every order. The invoice is issued using the details provided in the order; a request for an invoice to a receipt must be submitted no later than when the order is placed.
§ 7. Delivery
- We deliver Goods only within the territory of the Republic of Poland. Shipping abroad is priced individually after contacting the Seller.
- Available delivery methods and their costs: courier 19,90 PLN, parcel locker 14,90 PLN, personal collection 0.00 PLN. For orders with a value from 500,00 PLN, courier and parcel locker delivery is free of charge.
- Goods available in stock are dispatched within 24 business hours of the payment being credited. Goods ordered in from a supplier — within the period stated on the product page.
- The lead time for Goods made to individual order is agreed separately and confirmed by e-mail.
- Personal collection is possible after arranging it by phone in advance, at ul. Przykładowa 1, 00-000 Warszawa.
- We recommend inspecting the parcel in the presence of the courier. Refusal to draw up a damage report does not deprive the Consumer of their statutory rights, but it makes handling a transport claim considerably easier.
§ 8. Withdrawal from the contract
- A Consumer and an entrepreneur with consumer rights may withdraw from a distance contract within 14 days without giving a reason and without incurring costs other than those indicated below.
- The period runs from the day on which the Consumer, or a third party indicated by them other than the carrier, took possession of the Goods. For an order covering several items delivered separately — from taking possession of the last of them.
- It is sufficient to send the withdrawal statement before the deadline expires — by post to ul. Przykładowa 1, 00-000 Warszawa or by e-mail to sklep@bizongarage.pl. You may use the template available on the “Returns and complaints” page, but it is not mandatory.
- The Goods must be returned without delay, no later than within 14 days of submitting the statement. The direct cost of returning the Goods is borne by the Consumer.
- The Seller refunds all payments received, including the cost of the cheapest delivery method offered, within 14 days of receiving the statement. The Seller may withhold the refund until the Goods are received or until proof of their return is provided — whichever occurs first.
- The refund is made using the same payment method the Consumer used, unless they expressly agree to another method that involves no cost for them.
- The Consumer is liable for any diminished value of the Goods resulting from handling them beyond what is necessary to establish their nature, characteristics and functioning. In practice: a part may be test-fitted, but once installed and used (traces of exhaust gases, heat discolouration, cutting, drilling) it cannot be restored to its original condition.
- The right of withdrawal does not apply to contracts where the subject of the performance is a non-prefabricated item, produced to the Consumer's specification or serving to satisfy their individualised needs (art. 38 point 3 of the Polish Consumer Rights Act) — this covers parts made to individual order.
§ 9. Complaints: conformity of the goods with the contract and warranty for defects
- The Seller is obliged to deliver Goods free from defects and conforming with the contract.
- Towards Consumers and entrepreneurs with consumer rights, the Seller is liable for the lack of conformity of the Goods with the contract under the rules of chapter 5a of the Polish Consumer Rights Act. The liability covers a lack of conformity existing at the time of delivery of the Goods and revealed within 2 years from that moment.
- The Consumer may demand repair or replacement of the Goods. If repair and replacement are impossible or would require excessive costs, and also if the Seller fails to bring the Goods into conformity with the contract within a reasonable time and without excessive inconvenience, the Consumer may submit a statement on a price reduction or on withdrawal from the contract.
- Towards Customers who are not Consumers, the warranty for defects regulated in the Polish Civil Code applies, provided that the Seller's liability under that warranty is limited to the value of the order.
- A complaint should be submitted by e-mail to sklep@bizongarage.pl or in writing to ul. Przykładowa 1, 00-000 Warszawa, stating the order number, a description of the problem and — if possible — photographs.
- The Seller responds to a complaint within 14 days of receiving it. Failure to respond within that period means the Consumer's complaint has been accepted.
- Regardless of the above, the Goods may be covered by a manufacturer's guarantee. The guarantee does not exclude, limit or suspend the rights arising from the lack of conformity of the Goods with the contract.
- A complaint does not cover damage resulting from incorrect installation, use contrary to the intended purpose, unauthorised modifications or normal wear and tear of consumable components.
§ 10. Out-of-court complaint handling and redress procedures
- A Consumer may use out-of-court complaint handling and redress procedures, in particular by applying to the permanent consumer arbitration court at the provincial inspectorate of the Trade Inspection, requesting the provincial inspector of the Trade Inspection to initiate mediation proceedings, or seeking assistance from the district (municipal) consumer ombudsman or from a social organisation dealing with consumer protection.
- Detailed information is available on the website of the Office of Competition and Consumer Protection — Urząd Ochrony Konkurencji i Konsumentów, UOKiK (uokik.gov.pl).
- Use of these procedures is voluntary and requires the consent of both parties to the dispute.
§ 11. Personal data
The controller of Customers' personal data is the Seller. The data is processed in order to handle orders, operate the account, examine complaints and fulfil tax and accounting obligations. Full information — including the legal bases, retention periods and the rights of data subjects — is set out in the Privacy Policy.
§ 12. Final provisions
- Contracts are concluded in the Polish language, under Polish law.
- The Seller reserves the right to amend these Terms and Conditions for important reasons, in particular a change in legal provisions, payment methods or delivery methods. An amendment does not affect orders placed before it came into force.
- Customers holding an account are informed about an amendment to the Terms and Conditions by e-mail at least 14 days before it comes into force.
- In matters not regulated herein, the provisions of the Polish Civil Code, the Polish Consumer Rights Act and the Polish Act on Providing Services by Electronic Means apply.
- Any disputes with a Customer who is not a Consumer are settled by the court having jurisdiction over the Seller's registered office.
Legal note: the sales contract is concluded with a Polish seller, BizonGarage, and is governed by Polish law. This English text is a translation provided for convenience — in the event of any discrepancy, the Polish version of this document prevails.
